Drafting Secondary Legislation Survey

The Departmental Solicitor’s Office has identified an increased need for legal support in drafting secondary legislation as the content of our law diverges increasingly from that in England, due to devolution, Brexit and other issues.  We predict a particularly high requirement during and immediately after the Brexit transition period. We are developing our services and intend to move towards a position where complex and substantial secondary legislation is drafted by DSO lawyers, instructed by subject expert civil servants, as opposed to drafting by policy officers as at present.

Why we are consulting

To develop this service, we are engaged in a demand forecasting exercise. We would be grateful if you would distribute this to all business areas in your Department which draft statutory rules (even occasionally), to be filled out at Branch level. The survey should take no more than 10 mins to fill in and the knowledge required to complete it is likely to sit at SO, DP or G7 level. We would be grateful for returns by 30th July 2020.
