The Charities Acts (Northern Ireland) 2008 and 2013 establish a regulatory framework for all charities in Northern Ireland.  The Acts establish the Charity Commission for Northern Ireland as the independent statutory regulator.  Under this legal framework, all charities are required to register with the Charity Commission and once registered, to report annually on their activities and finances.  The Charity Commission has power to both support charities to carry out their charitable purposes in accordance with their governing documents and to monitor that charities are actually doing so.  The Charity Commission also has enforcement powers to ensure that those in control of charities do not engage in misconduct or mismanagement of charitable resources. 

The Independent Panel has been appointed to carry out a review of the legal and regulatory framework within which the Charity Commission operates and of the Commission’s relationships with stakeholders.  The review will examine whether the existing charity legislation is fit for purpose and whether the Commission’s efforts within that legal framework strike the right balance, in light of best practice, between supporting charities to do the right thing and deterring or dealing with misconduct. 

Why your views matter

This Questionnaire gives the Panel the opportunity to consider your opinion and expertise on the issues raised in the questionnaire, to review the system of charity regulation in Northern Ireland.  Whether you are a charity trustee, a member of a charity, a charity volunteer or a member of the public that supports or benefits from charities, we want to hear about your lived experiences of charity regulation. What works well? What could work better? We are also interested in hearing the views of funders and other regulators or bodies that interact with the Charity Commission.  You are invited to express your views on the matters raised by the Review Terms of Reference in relation to charity regulation and advise the Independent Review Panel of any specific interests or concerns that you have.

Your responses to this questionnaire will make an important contribution to the Panel’s work and the results will assist the Panel to make recommendations for optimal charity regulation in NI.

What happens next

The online questionnaire has now closed. Thank you for your input. The Panel is currently reviewing all submissions received and will be making its report and recommendations to the Minister later this summer. Details on the outcome of this Review will be available here at a later date.
